General terms and conditions of the coding school for the open course program. Separate conditions apply to services that the coding school provides on behalf of the customer.  

 

  1. General
    The services and offers of Tech and Teach gGmbH Düsseldorf (hereinafter: "Coding School") are based exclusively on these General Terms and Conditions. These are part of all contracts that we conclude with our course participants for the courses/training courses we offer.

     

  2. registration
    2.1 The courses/training courses of the coding school can be viewed on our websites: www.codingschule.de and www.codingschule-junior.de. To book a course/training, prior registration is required via the services made available for this on the website. We use external service providers (including Eventbrite, Pretix, Stripe, PayPal) to provide the option of booking, paying for and managing tickets and documents for our courses/training courses. Details: see privacy policy .
    2.2 Registration is binding upon receipt of the course fee by the coding school.

     

  3. Payment / Voucher Conditions
    3.1 Unless other payment terms have been agreed, the participation fee is due immediately and must be paid at the time of the order/booking that is subject to payment via the services of Eventbrite or Stripe or PayPal.
    3.2 The following payment methods are regularly offered via Eventbrite or Pretix: credit cards or PayPal.
    3.3 In the event of late or withdrawn payment, we can exclude the participant from participating in the course and allocate the place to someone else.
    3.4 Vouchers purchased via our online shop (https://tickets.codingschule.de) can be redeemed for all courses on our Codingschule.de website. The voucher and any remaining credit can be redeemed up to the end of the third year after the year in which the voucher was purchased. The voucher can only be redeemed before completing the order/purchase process. Subsequent offsetting is not possible. Voucher credit is neither paid out in cash nor does it earn interest. The voucher is transferrable. The seller can make payments to the respective owner with discharging effect. This does not apply if the seller has knowledge or grossly negligent ignorance of the non-authorization, the legal incapacity or the lack of the right to represent the respective owner.

     

  4. Failure of the course / cancellation
    4.1 Unless otherwise stated in the course description, a course/training will only take place if there are registrations for at least half of the maximum number of places. Unless otherwise stated in the description, each course/training has a maximum of twelve participants. Registrations that go beyond this cannot be considered.
    4.2 The coding school reserves the right to cancel a course if the number of participants is insufficient. Furthermore, the coding school reserves the right to cancel a course or appointment if the trainer is unable to work on the course date and a replacement trainer cannot be organized in good time or there is another unforeseen obstacle to performance which cannot be overcome through reasonable expenses of the coding school and the coding school is not responsible for this obstacle.
    4.3 If the minimum number of participants is not reached, the coding school will inform the participant, no later than five working days before the start of the course, that the course will not take place and reimburse the participant for any remuneration already paid.
    4.4 If a course participant cancels a course in whole or in part, this must be done as early as possible. Course fees already paid will not be refunded. However, it is possible to arrange alternative dates after consultation with the coding school. The statutory right of revocation ( revocation instruction ) remains unaffected.

    Multi-day/partial courses
    4.5 If the participant does not attend a course date, there is no entitlement to a replacement lesson or reimbursement of the fee.
    4.6 If a course date is canceled due to the trainer being unable to attend, an alternative date will be offered (if possible). The coding school is responsible for choosing the date. If no alternative date can be found, the date is cancelled. There is only a right to a proportionate refund if less than 90% of the planned course hours were offered. The reimbursement amount is calculated based on the difference between the percentage of hours actually offered and 90 percent. Upon request, the fee for the period will be reimbursed pro rata.

     

  5. Supervision of face-to-face courses
    5.1 Course participants are expressly advised not to take any valuables with them to the courses. The coding school assumes no liability for valuables, clothing, money, etc. that you bring with you.
    5.2 Participants will not be looked after before and after the courses. The coding school’s duty of supervision for minors begins and ends with the specified course time.
    5.3 If a participant disrupts the course for a long time, the trainer conducting the course is entitled to exclude the participant from the course. A lasting disruption exists in particular if orderly teaching can no longer be guaranteed.
    5.4 In the case of known health impairments that require or are likely to require medication for a course participant who is underage during a course, it is imperative that a legal guardian is present for the entire duration of a course and that the corresponding administration of medication is carried out directly by the legal guardian. In any case, the coding school must be informed by a parent or guardian at the time the course is booked that such a measure is necessary.

     

  6. online trainings

    6.1 Own provision of suitable IT infrastructure and software
    The course participant is obliged and responsible for creating the technical requirements for the online training. This is done at your own expense and risk and includes, by way of example and not exhaustively:

    - Providing and guaranteeing Internet access
    - Provision of hardware (laptop or PC, camera, headset or speakers, microphone)
    if necessary, registration with third-party providers
    - the installation of required software on your own device
    6.2 Conference Platform
    The online training takes place on the Zoom conference platform. By registering for an online training course and using Zoom's services to participate in the coding school's courses/training courses or allowing others to use the services on behalf of the course participant, the course participant agrees that Zoom may collect personal data or other information, that Zoom receives as a result of such use will be collected, used, disclosed, transmitted, and stored in accordance with Zoom's Privacy Policy.     6.3 Programming Environments
    The coding school uses various web-based programming environments (IDE) to convey the content. When using these tools, the respective usage and data protection regulations of the providers apply:

    - Scratch: https://scratch.mit.edu/privacy_policy or https://scratch.mit.edu/terms_of_use
    - kaggle: https://www.kaggle.com/privacy or https://www.kaggle.com/terms
    6.4 Availability
    The coding school has no influence on the general and technically flawless availability of the tools used (conference platform and programming environments). Should there be disruptions or the applications used not being available, this is not within the sphere of influence of the coding school. Any absences in online offers of the coding school caused by this will be repeated at a later date if possible. If the course participant is unable to attend repeat appointments, the pro rata participation fee can be refunded.

     

  7. Limitation of Liability
    In principle, the coding school is not liable for damage suffered by course participants. This does not apply to liability for breach of an essential contractual obligation and for liability for damage to the course participant resulting from injury to life, limb or health, nor for damage resulting from an intentional or grossly negligent breach of duty by the coding school, its legal representatives or vicarious agents are based. Significant contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely.

     

  8. copyrights
    8.1 All course documents handed out are created by the coding school and/or their trainers and are protected by copyright. Duplication or other use is possible with regard to the course documents licensed under the Creative Commons license CC-BY-SA. Duplication or other use of all other copyrighted course documents is not permitted without the prior written consent of the coding school.
    8.2 All materials/components distributed in the courses are the property of the coding school and must be left on the coding school's premises.

     

  9. privacy
    9.1 The coding school is entitled to store and use personal data about the course participants internally for processing the registration, implementation and follow-up of the courses (according to Art. 6 Para. 1 S. 1 lit. f DSGVO). It will only be passed on to third parties if and to the extent that this is necessary for the purpose of processing the contract and/or for billing purposes.     9.2 Esp. As part of the registration, personal data about the course participants will be sent by the course participants themselves to Eventbrite Inc., 651 Brannan Street, Suite 110, San Francisco, CA 94107, USA or pretix, Raphael Michel, rami.io Software development, Markgräfler Straße 16 , 69126 Heidelberg, Germany (see Section 2 of these General Terms and Conditions). If the course participant uses the services of Eventbrite or pretix to book the courses/training courses of the coding school (see section 2.) or allows others to use the services on behalf of the course participant, the course participant agrees that Eventbrite / Pretix personal data or other Information that Eventbrite / Pretix receives as a result of such use will be collected, used, disclosed, transferred and stored in accordance with the Eventbrite / Pretix Privacy Policy.     9.3 The course participant can obtain information about the data relating to him/her stored by the coding school and how it is processed and used by the coding school at any time. The course participant can revoke their consent to the collection, processing and use of their personal data by the coding school at any time with effect for the future by means of a declaration to the coding school in text form (e.g. letter, fax, e-mail).

     

  10. Final Provisions
    10.1 Oral ancillary agreements, changes and additions to these GTC must be in writing. This written form clause can also only be changed or canceled in writing.
    10.2 Should a provision of these GTC be ineffective, the validity of the remaining provisions shall not be affected. The provision that comes as close as possible to the intended purpose in legal terms should replace the ineffective agreement. The same applies if a gap occurs.
